These Sales Terms and Conditions (Sales Terms) apply to all sales of products and services by EUROFIT TOWBARS & ELECTRICS PTY LTD (ABN 49 635 282 629) (we, us, our) to you, the purchaser (you, your). These Sales Terms are available on our website at eurofittowbars.com.au (Site).
By purchasing products or services from us, you acknowledge that you have had sufficient opportunity to read, understand, and agree to these Sales Terms.
Nothing in these Sales Terms excludes, restricts, or modifies any consumer guarantees or rights you may have under the Australian Consumer Law (ACL).
1. Customer Accounts
If you create an account on the Site, you are responsible for maintaining the confidentiality of your account details and for all activity conducted under your account.
2. Products, Services and Orders
You may view products at our premises by appointment.
All orders are subject to acceptance by us. We may accept, reject, or cancel an order at our discretion, including due to availability, pricing errors, payment issues, or inability to contact you.
You are responsible for ensuring all order details, including vehicle information, product selection, and pricing, are correct prior to completing your purchase.
A binding contract is formed once we issue an order confirmation or invoice.
Product Purpose and Compatibility
Product images, photographs, diagrams, and illustrations on the Site or in marketing materials are provided for general reference only. Products supplied may vary slightly in appearance, finish, markings, packaging, or minor cosmetic details due to manufacturer updates, batch variations, or display stock. Such variations do not constitute a defect where the product remains functionally equivalent and fit for its intended purpose.
Product compatibility is determined by manufacturer specifications and vehicle design based on the information provided by you.
A product will not be considered defective, incompatible, or not fit for purpose solely because a third-party installer refuses or is unwilling to install it. An installerās opinion or refusal does not constitute a failure of the goods under the ACL.
Fit for purpose means the product is designed and manufactured for the relevant vehicle model. It does not guarantee installation by any specific installer or acceptance by third parties.
Some products may be intended for off-road or private property use only. You are responsible for ensuring compliance with applicable laws and regulations.
3. Price and Payment
All prices are in Australian dollars and include GST where applicable. Delivery, insurance, duties, taxes, and import charges (where applicable) are your responsibility.
If a pricing error is identified prior to dispatch, we may correct the price and notify you. You may elect to proceed at the corrected price or cancel for a full refund of any amount paid.
If supplier pricing or freight charges change prior to dispatch, we may notify you of the revised total. You may proceed or cancel the order for a refund of amounts paid (excluding any non-refundable deposits for special orders).
Payment must be made using the methods available on the Site. We reserve the right to recover unpaid amounts, including reasonable recovery and administrative costs.
4. Installations and Installer Referrals
We may offer installation services or provide referrals to third-party installers at your request.
Third-party installers operate independently. We make no representations or warranties regarding their services and accept no liability for their advice, decisions, workmanship, or refusal to perform an installation.
If additional labour or parts are required due to pre-existing faults, modifications, corrosion, prior repairs, or inaccurate vehicle information provided by you, additional charges may apply. We will advise you where reasonably practicable before proceeding.
A third-party installer declining to install a product does not indicate that the product is defective, incompatible, or not fit for purpose.
5. Availability, Delays and Cancellations
All products and services are subject to availability.
If we cannot supply an ordered product or service within a reasonable time, you may choose a refund, store credit, or backorder.
Orders for special-order items, custom-ordered parts, or items sourced specifically for you may not be cancelled once the order has been placed with the supplier. Any deposits paid for such orders are non-refundable unless required by the ACL.
Deposits for bookings cancelled with less than 24 hoursā notice are non-refundable.
6. Delivery and Risk
We deliver worldwide where available.
Risk in goods passes to you upon delivery. Title passes once payment has been received in full.
We will replace or refund goods that are damaged or lost in transit in accordance with the ACL and courier claims processes.
7. Promotions
Discount codes and promotions are subject to specific terms and must be applied at checkout. Promotions cannot be applied retrospectively unless required by law.
8. Intellectual Property
All intellectual property on the Site, including branding, images, text, and product information, remains our property.
9. Dispute Resolution
If a dispute arises, the parties agree to attempt to resolve it in good faith. If unresolved, the matter may be referred to mediation through the Law Society of Queensland prior to commencing proceedings.
10. Consumer Law, Returns and Refunds
Our goods and services come with guarantees under the ACL.
You are entitled to a repair, replacement, or refund where goods fail to meet a consumer guarantee.
Refunds or replacements will be provided where a defect or failure is demonstrated. Installer opinions or refusals do not constitute evidence of a defect.
Change-of-mind refunds are not accepted. Change of mind includes deciding not to proceed, being unable to find an installer, or no longer wishing to install the product.
Display items, demonstration stock, and special-order products are not eligible for return or refund unless proven to be defective under the ACL.
Any concerns regarding product fault, compatibility, or suitability should be reported within 30 days of delivery to allow prompt assessment. This reporting timeframe does not limit your ACL rights, however delays may be taken into account when assessing the claim and appropriate remedy.
Returns require prior approval. Returned products must be unused, in original packaging where applicable, and adequately packaged and insured. Return shipping costs are your responsibility unless the return is due to an ACL failure.
Refunds, where applicable, will be processed via the original payment method.
11. Limitation of Liability
To the extent permitted by law, our liability is limited to the remedies available under the ACL. We are not liable for indirect, consequential, or economic loss.
12. Amendments
We may amend these Sales Terms from time to time. Continued purchases constitute acceptance of the updated terms.
13. Indemnity
You indemnify us against losses arising from your breach of these Sales Terms or misuse of products.
14. General
These Sales Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of Queensland courts.

These Sales Terms constitute the entire agreement between you and us.
